Kelvin O. Mbogo is a Partner and the Head of the Litigation and Dispute Resolution Department. He has vast experience handling litigation and dispute resolution before Kenyan and international forums, including the International Centre for State Investment Disputes (ICSID) and the Permanent Court of Arbitration (PCA). His expertise spans Public Procurement Law, Commercial Litigation, Employment and Labour disputes, Constitutional and Judicial Review matters.

Kelvin’s clients include governments, state corporations across multiple sectors, leading banks, and multinational entities. He has contributed to landmark cases in Kenya, such as presidential petitions and the NHIF case of 2022. Notably, Kelvin has acted as lead counsel for governments in cross-border disputes and commercial claims valued at over USD 12 million.

He adopts a solutions-oriented approach, regularly advising on mediation and negotiations, and has conducted legal audits, governance reviews, and due diligence exercises. A all-rounded professional and researcher, Kelvin champions continuous learning and mentorship. He currently serves as the Chairperson of the Young Bar Association.

  • Represented a state corporation managing natural resources before the National Environmental Tribunal in a USD 70 million (KES 9.1 billion) energy project dispute.

  • Successfully defended a state power corporation in a USD 112 million (KES 14 billion) breach of contract claim regarding the supply of electrical equipment.

  • Conducted legal due diligence and audit for a bank involved in a merger with a Nigerian-headquartered multinational.

  • Successfully defended a tier one bank in USD 7.8 million (KES 97 million) proceedings to stop a property auction due to loan default.

  • Defended a transport sector state corporation in procurement review proceedings for a USD 32.8 million (KES 4 billion) tender.

  • Defended another transport sector state corporation in procurement proceedings for a USD 5.7 million (KES 690 million) tender.

  • Represented a county government in a petition concerning a USD 73.8 million (KES 9 billion) housing project, involving displacement, environmental, and constitutional issues.

  • Defended an energy sector state corporation in a procurement dispute over multi-million equipment from the administrative review board to the Court of Appeal.
